Sales Procedure in Turkey
Sales Procedure The buying procedure in Turkey is straightforward with Turkey Property Centre. We will be responsible for all aspects of the buying procedure and all the legal documentation required.
These are our buying process steps.
1. Property search 2. Deposit/reservation 3. Sales contract 4. Power of attorney 5. Military approval 6. Title deed transfer (Tapu)
Step 1 - Property search After discussing your needs and requirements we will arrange a viewing. During your property search in Turkey will look at various properties that best suite your needs and expectaions. Step 2 – Deposit/reservation Once a suitable property has been found you will need to secure it by putting down a deposit. This is usually 10-20% of the purchase price, however, during the purchase the exact figure will be discussed with the house owner or builder. A receipt for the deposit is given and the amount is written into your sales contract. Step 3 – Sales contract A sales contract will be drawn up between Turkey Property Centre and yourself. The information in the sales contract will include your paid deposit information, agreed sale price, date of transfer, snag list (if applicable) and/or date of completion of property (off-plan projects). Two passport size photographs is required for the property deeds and a photocopy of your passport. Step 4 – Power of attorney If you are not going to be present in Turkey during the actual purchase of your property, we will take you to the Notary's office (similar to Notary public in the UK) to sign a document giving Turkey Property Centre or your solicitor, the power of Attorney for the property. (not for money) This enable Turkey Property Centre to obtain the Title Deeds in your absence. Step 5 –Military approval Property details and information about yourself (the purchaser) are forwarded to the Land Registry Office. An official transfer application is made and all documentations get sent to the Izmir Aegean Army for approval. This is to check that the property is not located in a restricted zone for foreign purchase etc. Approval normally takes 3 - 6 months Step 6 - Title Deed Transfer (Tapu) Once all military approval documentation has been finalized, your title deeds are re-issued into your name and forwarded back to the local Land Registration office. Turkey Property Centre will collect your title deeds on your behalf and kept in a safe place pending your next visit.
Buying Costs Main Property Purchasing Costs
Purchase tax: 3.3% on the ‘declared’ value of the property to be paid to the government. As house prices are set by the City Council for taxing purposes, their valuation is much lower than the actual purchase price This is a one off payment and it is due once the TAPU is received The solicitor's fee:(should you require one) Prices start from about £500.00 pounds and will vary depending on which solicitor you choose to use. Notary charge: Approximately £150-200 notary charge for the power of attorney and the translation of your passport. Map search: 2 maps are needed. The first is a map of where the property is located and is sent to the Izmir Aegean Army. This costs approx. £35. The second is a 1/5000 map used in the title deed process. This costs approx. £400 but price varies for different Municipality areas.
